Stay OSHA Compliant with AssuredPartners RMC Incident Tracking

With the OSHA 300 season just around the corner and recent OSHA recordkeeping changes in place, AssuredPartners has a quick and efficient way to stay compliant.

As a reminder, employers with more than ten employees, and whose establishments are not classified as a partially exempt industry, must record work-related injuries and illnesses using OSHA Form 300, 300A, and 301. Employers who are required to keep Form 300, the Injury and Illness log, must post Form 300 A, the summary of Work-related Injuries and Illnesses in their workplace every year from February 1 to April 30. Current and former employees, or their representatives, have the right to access injury and illness records. Employers must give the requester a copy of the relevant record(s) by the end of the next business day.

The U.S. Department of Labor will now require certain employers in designated high-hazard industries to electronically submit injury and illness information, which they are already required to keep, to the department's Occupational Safety and Health Administration.

The new rule took place on January 1, 2024, and now includes the following submission requirements:

  • Establishments with 100 or more employees in certain high-hazard industries must electronically submit information from their Form 300-Log of Work-Related Injuries and Illnesses and Form 301-Injury and Illness Incident Report to OSHA once a year. These submissions are in addition to the submission of Form 300A-Summary of Work-Related Injuries and Illnesses.
  • To improve data quality, establishments are required to include their legal company name when making electronic submissions to OSHA from their injury and illness records.
  • The final rule retains the current requirements for electronic submission of information from Form 300A from establishments with 20-249 employees in certain high-hazard industries and from establishments with 250 or more employees in industries that must routinely keep OSHA injury and illness records.
  • Covered employers must record all work-related fatalities;
  • Covered employers must record all work-related injuries and illnesses that result in days away from work, restricted work or transfer to another job, loss of consciousness, or medical treatment beyond first aid.
  • Employers must record significant work-related injuries or illnesses diagnosed by a physician or other licensed healthcare professional, even if it does not result in death, days away from work, restricted work or job transfer, medical treatment beyond first aid, or loss of consciousness;
  • OSHA defines work-related injuries, illnesses, and fatalities as those in which an event or exposure in the work environment either caused or contributed to the condition. In addition, if an event or exposure in the work environment significantly aggravated a pre-existing injury or illness, this is also considered work-related.
    • Injuries include cases such as, but not limited to, a cut, fracture, sprain, or amputation;
    • Illnesses include both acute and chronic illnesses, such as, but not limited to, skin diseases (e.g., contact dermatitis), respiratory disorders (e.g., occupational asthma, pneumoconiosis), or poisoning (e.g., lead poisoning, solvent intoxication).

AssuredPartners offers the RMC platform, which makes recording and tracking near misses and incidents quick, efficient, and secure. Within RMC's Incident Track, our clients can organize everything from near misses to serious injuries, which will populate the OSHA 300 logs that can be produced out of the Incident Track module.

While you can create roles in RMC that allow access to certain levels of access and "permissions" to certain functions to create a "Quick Report" role in Incident Track, first, you need to create a new Role in the "Administration" tab. The Quick Report Role allows employees and supervisors, who have been granted access, to create the initial report and upload any photos and documents.

  • The "Quick Report" role will allow a user to report incidents in the Incident Track without having full access to the platform. They can report the basic incident information, and then it will be sent to the preselected "distribution" list.
  • "Report & Investigate" permission does not allow the user to close incidents; it only allows the user to report that they occurred or investigate current incidents. In contrast, full permission allows the user to close the incidents as needed.
